I lost my job, and also my fiance walked out on me leaving me with the mortgage. I have been put on a plan for 3 months to pay a partial amount, and they extended it for 3 more months. That is up in March. They will not modify my loan till I get a job. I have not been able to find work but still keep paying the 2nd mortgage, and the 1st that has been lowered. My hours were cut a work for a long time, my husband was in the hospital and my daughter was in the hospital for 1 month on bedrest in Chicago while she was pregnant with her daughter. My granddaughter was then born 2 1/2 months early. A year ago we tried to work with Washington Mutual to help with our loan and they just made it worse. Our payments went from 600.00 to 1900.00. We then tried another loan modification company and lost our $1500.00. We could never reach them on the phone after they received our money. Then we tried Save Our Home because they were affiliated with the BBB but when we could not come up with the $1600.00 in 7 days they "put us in the recycle bin". This was after they told us not to make anymore payments. I did however find you and hope that you can help me. I am currently 4 months behind and I cannot afford a $1900 mortgage. Due to marriage separation, severe cutbacks on job employment payroll and serious tax delinquencies, I was forced to refinance my home in Los Angeles, CA. There is no question but that the numerous numbers of unscrupulous, overzealous, and misleading broker(s) and lender(s) have created a horrendous mess of the mortgage lending industry and more which has led several major lenders and multi-billion dollar hedge funds to file for Bankruptcy Protection, Major banks are even failing, e.g., most recently IndyMAC. Furthermore, to add to my problems, I have severe tax liabilities amounting to over $130,000 due to my not being able to properly shelter the investments made to DPI with my retirement pension funds. I have issued Offer In Compromise (OIC) applications to both the IRS and Franchise Tax Board (FTB) with a request for lower payoff amounts ($30,000 to IRS and $10,000 to FTB). Neither has been accepted. DPI has offered to make the OIC payments for me, which is of some relief for me. At this point, I have nearly paid off all of my credit cards. The terms (40 years-10 year fixed) of my existing $540,000 mortgage contract note (@8.6%), initiated by Argent Mortgage Co., LLC located at One City Boulevard West, Orange, CA 92868, (Phone: (883) 311-4721) and subsequently purchased by WaMu, effective on or about June 02, 2007, is a prime example of deceptive and misleading tactics applied by certain lenders to entice and entrap borrowers into loan contract(s) which are ultimately designed to fail. Prepayment penalties exist at the rate of nearly 6 times my current mortgage payment of $3,994.84 (nearly a whopping $24,000-un-heard of!). Furthermore, with the current real estate market downturn, the value of my home is significantly less than the balance owed. The median sales price as of November 2008 for homes sold in the Los Angeles/Baldwin Hills area (Zip Code 90008) is approximately $375,000 (~$165,000 less that my current WaMu mortgage!). Washington Mutual is my mortgage company. I have solicited the help of Lucas Law Center to re-negotiate my loan but with no positive benefit received (after having over paid Lucas Law $5250 . I feel used and manipulated. My current net monthly income is at or about $7500/month net. MY CURRENT NOTE IS AT $3,999.84 PER MONTH FOR A PRINCIPAL BALANCE OF $537,000 PLUS LATE PAYMENTS/FEES TOTALING $25,800 FOR A WHOPPING PRINCIPAL AMOUNT DUE OF $562,800 (ESTIMATED). WITH $7500 NET/MONTH, THERE IS NO WAY THAT I CAN MAKE THESE PAYMENTS. I WANT TO KEEP MY HOME BUT I WILL NEED A PRINCIPAL REDUCTION AT MIN 38% WITH A 30 OR 40 OR 50 YEAR FIXED RATE AT 5% OR LESS.
